About Echo Rising

House of Echo Rising operates the Echo Rising online storefront and offers apparel, accessories, Collector Editions, limited releases, preorder merchandise, and related products and services.

References to “Echo Rising,” “House of Echo Rising,” “we,” “us,” or “our” refer to the business operating the applicable Echo Rising storefront.

Eligibility to Use the Store

By using our website or purchasing merchandise, you represent that you have the legal capacity to enter into a binding transaction or that you are using the website with the permission and supervision required by applicable law.

You may not use the website or our services for unlawful, fraudulent, abusive, or unauthorized purposes.

Shopify

Our online store is hosted and supported by Shopify. Shopify provides the ecommerce technology that allows us to display merchandise, operate checkout, process transactions, and provide related functionality.

Certain Shopify services, payment services, or third-party integrations may be subject to additional terms and privacy practices.

Products & Product Information

We make reasonable efforts to describe our merchandise accurately, including materials, colors, dimensions, sizing, fit, features, availability, limited-edition quantity, and other relevant product information.

Colors and appearance may vary slightly depending on display settings, lighting, photography, manufacturing tolerances, material behavior, or other reasonable variations.

Product descriptions, photography, measurements, specifications, availability, and other information may be updated when appropriate.

We do not intentionally misrepresent product features, pricing, availability, or performance.

Pricing

Prices are displayed in the currency shown on the website or at checkout and may change without prior notice before an order is completed.

The price applicable to a completed purchase is the price presented during the applicable checkout transaction, subject to correction of genuine errors as permitted by law.

Taxes, shipping charges, duties, customs charges, or other applicable fees may be added where appropriate and will be disclosed as applicable before or during checkout.

Orders

Submitting an order does not necessarily guarantee acceptance or fulfillment.

We reserve the right to review, decline, limit, or cancel orders where reasonably necessary, including in cases involving:

• Suspected fraud or unauthorized payment activity.
• Incorrect pricing or product information.
• Inventory or availability errors.
• Purchase-limit violations.
• Suspected resale abuse.
• Technical errors.
• Violation of these Terms.
• Legal or regulatory restrictions.

If we cancel an order after payment has been successfully captured, the applicable amount will be refunded as required.

Payment

By providing payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charge for your order.

Payments may be processed by Shopify Payments or another authorized payment provider.

Orders may be subject to payment verification, fraud screening, authorization holds, or other security procedures.

Presales & Preorders

Certain Echo Rising merchandise may be sold through a presale, preorder, or other advance-purchase format.

Preorder merchandise is not ready for immediate shipment. Customers should review the estimated fulfillment timeframe displayed on the applicable product page before purchasing.

Unless a different timeframe is specifically disclosed, certain presale merchandise may require approximately 5–6 weeks after the applicable presale window closes before shipment.

Product-specific preorder terms and our Shipping Policy may supplement this section.

Unexpected Shipping Delays

We make reasonable efforts to ship merchandise within the timeframe represented when an order is placed.

If we become unable to ship within a previously represented timeframe, we will provide applicable delay information and available options as required by law.

Depending on the circumstances, customers may be asked to consent to a revised shipment date or may be given the opportunity to cancel affected unshipped merchandise and receive the applicable refund.

Collector Editions

Certain Echo Rising merchandise is produced as a limited Collector Edition.

When a Collector Edition is advertised as limited to a specific worldwide quantity, that quantity represents the intended maximum production of that edition.

Qualifying Collector Editions may include:

• Individual edition numbering.
• Certificate of Authenticity.
• Care instructions.
• Collector documentation.
• Specialty packaging or protective presentation.

Collector merchandise is also governed by our Collector Reservation Policy.

Edition Numbers

Individual Collector Edition numbers are generally assigned as part of fulfillment.

Customers may not demand, select, or guarantee a specific edition number unless number selection is expressly offered on the applicable product page.

An approved warranty replacement or exchange may not carry the same edition number as the original item.

Shipping

Shipping, processing, tracking, address requirements, international delivery, carrier issues, damaged shipments, and other fulfillment matters are governed by our Shipping Policy.

Customers are responsible for entering complete and accurate shipping information during checkout.

Large orders may be shipped in multiple packages. Each package may have its own tracking number.

International Orders

International ordering and shipping availability may vary by destination.

Customs duties, import taxes, brokerage charges, and other destination-related fees may apply.

Unless checkout specifically states otherwise, those charges may be the responsibility of the recipient.

International customers are responsible for complying with applicable import laws and restrictions.

Returns, Exchanges & Refunds

Return, exchange, refund, and warranty eligibility is governed by our Returns, Exchanges & Limited Warranty Policy.

Eligible regular-price merchandise may be submitted for return consideration within the return period stated in that policy.

Merchandise must satisfy all applicable condition and authorization requirements.

Approved voluntary returns and exchanges may be subject to the published restocking fee.

Nothing in these Terms eliminates rights that cannot legally be waived or restricted.

48-Hour Delivery Inspection

Customers should inspect merchandise promptly after delivery.

Visible manufacturing defects, incorrect items, missing items, missing collector components, or transit damage should be reported within 48 hours of confirmed delivery in accordance with our Returns and Shipping policies.

Clear photographs and packaging documentation may be required to evaluate a claim.

Limited Craftsmanship Warranty

Select high-value or Collector Edition merchandise may include a limited craftsmanship warranty when expressly identified on the product page or accompanying documentation.

Such warranty may cover verified defects in materials or workmanship existing at delivery.

Warranty coverage does not generally include:

• Normal wear and tear.
• Improper cleaning or storage.
• Accidental damage.
• Misuse or neglect.
• Unauthorized alterations.
• Customer-caused damage.
• Loss or theft.

Approved remedies may include repair, replacement, exchange, store credit, refund, or another appropriate remedy depending on the circumstances and applicable law.

Product Care

Customers are responsible for following the care instructions supplied with merchandise and any care label attached to the product.

Specialty materials, embroidery, leather, trims, hardware, coatings, or embellishments may require specialized care.

Damage caused by improper care may not qualify as a manufacturing defect.

Gift Cards, Promotions & Discount Codes

Gift cards, promotional offers, and discount codes may be subject to additional terms stated when they are issued.

Discounts may have expiration dates, eligibility requirements, product exclusions, quantity limits, or restrictions on combining multiple offers.

Promotional offers have no cash value unless otherwise required by law.

We reserve the right to correct or cancel promotions affected by obvious technical, pricing, or configuration errors, subject to applicable law.

Accounts

If customer accounts are available, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

Please provide accurate information and promptly notify us if you believe your account has been compromised.

We may suspend or restrict accounts involved in fraud, abuse, unauthorized activity, policy violations, or security risks.

Acceptable Use

You may not use the website or services to:

• Violate applicable law.
• Commit or attempt fraud.
• Interfere with website security.
• Introduce malware or malicious code.
• Attempt unauthorized access to systems or customer information.
• Scrape or harvest personal information unlawfully.

Fraud, Chargebacks & Abuse

We reserve the right to review transactions for suspected fraud, unauthorized activity, return abuse, warranty abuse, promotion abuse, or other suspicious conduct.

We may provide transaction records, tracking details, order records, policy acknowledgments, communications, and other relevant documentation to payment processors, financial institutions, carriers, fraud-prevention providers, or authorities when reasonably necessary to investigate or respond to a dispute.

Nothing in this section prevents a customer from exercising a legitimate dispute or consumer right.

Reviews & Customer Feedback

Customers are welcome to provide honest reviews, opinions, and feedback about their experiences.

Echo Rising does not require customers to provide only positive reviews and will not penalize customers merely for expressing an honest opinion.

Reviews or submissions may nevertheless be moderated or removed when permitted by law if they contain unlawful material, confidential information, harassment, threats, spam, impersonation, unrelated commercial promotions, or content that violates applicable platform rules.

Customer Photos, Videos & Other Submitted Content

Customers may have opportunities to submit photographs, videos, reviews, testimonials, or other content to Echo Rising.

By submitting content specifically for public display or promotional use, you represent that you have the necessary rights and permissions to submit that content.

Any license or permission granted to Echo Rising for customer content will be governed by the applicable submission terms, promotion rules, consent language, or content-use policy presented in connection with that submission.

Please do not submit content depicting another person unless you have the necessary permission to do so.

Intellectual Property

Unless otherwise indicated, the Echo Rising website and its original content are owned by or licensed to Echo Rising and are protected by applicable intellectual-property laws.

Protected materials may include:

• Brand names.
• Logos and marks.
• The Echo Rising Foundation Mark.
• Original garment graphics and artwork.
• Product designs.
• Photography.
• Video.
• Written copy.
• Packaging designs.
• Website graphics and layouts.

Purchasing merchandise does not transfer intellectual-property rights in the underlying design, branding, artwork, or content.

Prohibited Commercial Reproduction

Except where permitted by law or authorized in writing, you may not reproduce, manufacture, copy, distribute, sell, license, or create unauthorized commercial derivatives of Echo Rising proprietary designs, artwork, branding, photography, or protected materials.

This provision does not prohibit lawful resale of genuine merchandise that you own.

Authenticity & Resale

Echo Rising guarantees authenticity only for merchandise purchased directly through authorized Echo Rising sales channels.

We cannot guarantee the authenticity, condition, documentation, storage history, or ownership history of merchandise acquired from unauthorized third-party sellers.

Collector numbering, Certificates of Authenticity, or limited availability do not represent a financial investment or guarantee future resale value.

Third-Party Links & Services

Our website may contain links to or integrations with independent third-party websites, applications, payment services, carriers, or other services.

Echo Rising does not control independent third-party services and is not responsible for their separate terms, privacy practices, content, availability, or acts and omissions except as required by law.

Website Availability

We aim to maintain reliable website availability but cannot guarantee uninterrupted, error-free, or continuously available access.

The website may occasionally be unavailable because of maintenance, technical errors, hosting interruptions, cybersecurity issues, upgrades, or circumstances outside our reasonable control.

Disclaimer of Warranties

Except for express warranties provided by Echo Rising and warranties or rights that cannot legally be excluded, the website and services are provided on an “as available” basis.

Nothing in these Terms excludes any warranty, guarantee, or consumer protection that applicable law does not permit us to exclude.

Limitation of Liability

To the maximum extent permitted by applicable law, Echo Rising will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of the website or services where such damages may lawfully be limited.

These limitations do not apply where liability cannot legally be limited or excluded.
